The three issues in this case are:

  1. Can Marcus recover 300 from Elsie, which she said she would pay but the offer was given after the task was done?
  2. Whether Marcus can terminate the counter offer after acceptance to validate the offer at the first place?
  3. Can Marcus accept the cheque of 35,000 and can further recover remaining 35,000 from Gary?

In the case of Marcus (a builder), there are three parties from which he is looking at opportunities to recover his money for the services he had provided to these parties. Since, Marcus remained unpaid or underpaid even after performing his part of the agreement with all these parties as per the agreed terms and conditions. Hence the English contract
