3. Pamela Jones offers (by a signed letter) Tom Smith $60,000 to build her a tree house. Tom Smith gladly accepts Pamela’s offer. Two months and a day after the agreement Tom Smith notifies Pamela Jones that he would not build tree house. Pamela objects. If Pamela decides to file a lawsuit what are her rights and what are, if any, Tom’s defense (s)? Please be sure to state ALL the various possibilities. If you assume any reasonable facts, you MUST STATE SAME. You may outline your answer. 

4. Nick brought his old half blue, half green pickup truck to Bob’s professional garage to have the brakes fixed. Nick brought his own parts and requested that Bob install them. Nick had evidently bought the wrong parts because they really didn’t fit, but Bob did the best he could. When Nick came for the truck, Bob said nothing about his problems. Nick got in the truck and noticed that the brakes were not working well, but drove off anyway because he was late for work. (20 points)

a.) If Nick is involved in an accident because of defective brakes, could he successfully sue Bob for negligence? Please be specific. Justify your answer.

b.) If a suit is filed what legal defense(s) can Bob raise? How successful could those defenses be? Explain.

5. CEO was convinced by his employee, Jennifer Goodgirl, that co-worker, I. M. Broke. had been stealing money from the company. At lunch that day in the company cafeteria, CEO discharges I.M. Broke from her employment, accuses her of stealing from the Company; searches through her purse over her objections; and finally forcibly escorts her to his office to await the arrival of the police, which he asked his secretary to summon. I. M. Broke is indicted for embezzlement but subsequently is acquitted upon establishing her innocence. What torts, if any did CEO commit against I.M. Broke?Please list the torts and briefly explain each of the torts and causes of action that you listed.

6. Global Products develops patents and markets software. World Copies, Inc. sells Global’s Software without the marker’s permission. Is this patent infringement? If so, how might Global be able to save the cost of suing World Copies Inc. for infringement and at the same time profit from World’s sales? 

7. After an oral contract for the sale of a tract of land has been made, Allen writes a letter to Bernard repeating that he will sell his land to Bernard and Allen signs the letter. Bernard refuses to buy, and Allen sues. Bernard asserts the Statute of Frauds. Decide.
